w związku z przetwarzaniem danych w KSeF
1. Administratorem Pani/Pana danych osobowych jest spółka pod firmą Centrum Edukacji
Międzynarodowej spółka z o.o. z/s w Krakowie, NIP: 675-154-32-99. Kontakt z Administratorem:
ul. Ślusarska 9, 30-710 Kraków.
2. Administrator wyznaczył Inspektora Ochrony Danych. W sprawach związanych z ochroną
danych można się skontaktować pisemnie na adres pocztowy Administratora lub drogą
elektroniczną pod adresem e-mail: iod@mbm.bielsko.pl
3. Dane osobowe będą przetwarzane na podstawie art. 6 ust. 1 lit. c ogólnego rozporządzenia
o ochronie danych osobowych (dalej: RODO) – obowiązek administratora w związku
z przepisami ustawy z dnia 11 marca 2004 roku o podatku od towarów i usług oraz rozporządzeniem
Ministra Finansów z 27 grudnia 2021 roku w sprawie korzystania z Krajowego Systemu e-Faktur
w celu wykonania obowiązku prawnego ciążącego na administratorze polegającego na
wykonywaniu czynności w systemie informatycznym Szefa Krajowej Administracji Skarbowej, tj.:
Krajowym Systemie e-Faktur (dalej: KSeF) polegającym na wystawianiu i odbieraniu faktur
ustrukturyzowanych.
4. Odbiorcami Pani/Pana danych osobowych mogą być:
1) podmioty z którymi Administrator zawarł umowę powierzenia przetwarzania danych
osobowych, które świadczą obsługę działalności administratora;
2) organy i inne podmioty, w tym podmioty publiczne, uprawnione do uzyskania Pani/Pana
danych osobowych na podstawie powszechnie obowiązujących przepisów prawa, a także
Szefowi Krajowej Administracji Skarbowej w związku z wystawianiem faktur w KSe-F.
5. Dane osobowe będą przetwarzane w ramach czynności polegającej na wystawianiu
i odbieraniu faktur, będą udostępniane wyłącznie podmiotom uprawnionym do ich przetwarzania
na podstawie przepisów prawa, tj.: policja, sądy, prokuratura, komornicy sądowi (inne organy
egzekucyjne).
6. Administrator nie ma zamiaru przekazywać Pani/Pana danych osobowych do państwa
trzeciego lub organizacji międzynarodowej, jak również nie będą wykorzystywane do celów innych
niż te, dla których zostały pierwotnie zebrane.
7. Pani/Pana dane osobowe będą przechowywane do momentu przedawnienia zobowiązania
podatkowego, dane osobowe (zawarte w fakturach) będą ponadto przechowywane w KSeF przez
okres 10 lat od momentu wystawienia.
8. Przysługuje Pani/Panu prawo dostępu do treści swoich danych oraz prawo sprostowania,
usunięcia w przepadkach przewidzianych przepisami prawa wniesienie roszczenia polegającego
na żądaniu ograniczenia przetwarzania danych osobowych.
9. Przysługuje Pani/Panu prawo wniesienia skargi do organu nadzorczego, tj.: Prezesa Urzędu
Ochrony Danych Osobowych z/s w Warszawie.
10. Podanie przez Panią/Pana swoich danych jest ustawowym obowiązkiem. Brak podania danych
skutkować będzie niemożnością wystawienia Fv, a tym samym zaprzestania współpracy.
11. W stosunku do Pani/Pana nie będą podejmowane decyzje w sposób zautomatyzowany, w tym
decyzje opierające się na profilowaniu.

INFORMATION CLAUSE

regarding the processing of personal data in connection with KSeF

1. The controller of your personal data is Centrum Edukacji Międzynarodowej spółka z ograniczoną odpowiedzialnością, with its registered office in Kraków, Tax Identification Number (NIP): 675-154-32-99. Contact with the Controller: ul. Ślusarska 9, 30-710 Kraków.
2. The Controller has appointed a Data Protection Officer. In matters related to personal data protection, you may contact the Controller in writing at the postal address indicated above or electronically via email at: iod@mbm.bielsko.pl
3. Personal data will be processed on the basis of Article 6(1)(c) of the General Data Protection Regulation (hereinafter: GDPR) – the legal obligation incumbent on the Controller under the provisions of the Act of 11 March 2004 on Goods and Services Tax and the Regulation of the Minister of Finance of 27 December 2021 on the use of the National e-Invoicing System, for the purpose of fulfilling a legal obligation consisting in performing activities in the IT system of the Head of the National Revenue Administration, i.e. the National e-Invoicing System (hereinafter: KSeF), including issuing and receiving structured invoices.
4. Recipients of your personal data may include:
   1. entities with whom the Controller has concluded personal data processing agreements, providing services supporting the Controller’s operations;
   2. authorities and other entities, including public bodies, authorised to obtain your personal data under generally applicable law, as well as the Head of the National Revenue Administration in connection with issuing invoices via KSeF.
5. Personal data will be processed as part of activities related to issuing and receiving invoices and will be disclosed only to entities authorised to process such data under applicable law, including: police, courts, prosecutors, bailiffs (other enforcement authorities).
6. The Controller does not intend to transfer your personal data to third countries or international organisations. The data will not be used for purposes other than those for which they were originally collected.
7. Your personal data will be stored until the limitation period for tax liabilities expires. Additionally, personal data contained in invoices will be stored in KSeF for a period of 10 years from the date of issuance.
8. You have the right to access your personal data and the right to rectification, erasure (in cases provided for by law), and to request restriction of processing.
9. You have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office (UODO) with its seat in Warsaw.
10. Providing your personal data is a statutory obligation. Failure to provide data will result in the inability to issue an invoice and, consequently, termination of cooperation.
11. No automated decision-making, including profiling, will be carried out with respect to you.
